النظام القانوني للمحل التجاري الالكتروني في التشريع الجزائري

الملخص
يهدف البحث الى ابراز مقومات كل من النظام القانوني للمحل التجاري التقليدي والنظام القانوني للمحل التجاري الالكتروني من خلال التشريع التجاري الجزائري و القانون المتعلق بالتجارة الالكترونية، بحثا عن ما اذا كان هذا الأخير يشتمل و يتضمن نفس المقومات او العناصر المكونة لمفهوم المحل التجاري ؟ كما هو معروف ان المشرع الجزائري لم يتعرض لإعطاء تعريف قانوني للمحل التجاري الالكتروني شأنه شأن المحل التجاري التقليدي مع اكتفائه بسرد مقوماته و ذكر عناصره. لذا يجب علينا تبيان العناصر المميزة للمحل التجاري الالكتروني عن المحل التجاري التقليدي. اذ يجب الالمام بالنظام القانوني للتجارة الالكترونية مثل ماجاء في القانون رقم 18-05. وما يمكن استخلاصه منه فيما يتعلق بالطبيعة القانونية للمحل التجاري الالكتروني التي تتدحرج بين قواعد الحماية القانونية للملكية التجارية و على رأسها كل من الحق في تجديد الايجار والتعويض بالإخلاء في حالة الرفض من جهة و قواعد حماية الملكية الفكرية من جهة أخرى و على رأسها الاسم التجاري وإسم النطاق أو الموقع التجاري. The research aims to highlight the components of both the legal system of the traditional commercial store and the legal system of the electronic commercial store through the Algerian commercial legislation and the law on e-commerce, in order to find out whether the latter includes the same components or elements that constitute the concept of a commercial store. As it is known that the Algerian legislator did not give a legal definition of the e-commerce store like the traditional commercial store, but only listed its components and mentioned its elements. Therefore, we must clarify the elements that distinguish the e-commerce store from the traditional commercial store. It is important to familiarize yourself with the legal system of e-commerce, such as that contained in Law No. 18-05. What can be deduced from it regarding the legal nature of the e-commerce store, which rolls between the rules of legal protection of commercial property, mainly the right to renew the lease and compensation for eviction in case of refusal, on the one hand, and the rules of protection of intellectual property on the other hand, mainly the trade name, domain name or commercial website.
