مفهوم تنفيذ قرارات القضاء الإداري

الملخص
يعرف التنفيذ بأنه عملية تحويل القانون إلى واقع، وهو ينتشر في جميع فروع القانون العام. ومع ذلك، يبدو أنه من الضروري التمييز بين سند التنفيذ وتنفيذه. فإذا كان سند التنفيذ متأصلًا في أي قرار قضائي، فهذا لأنه ملازم لوجود أي قرار، ولكنه يعزز فيما يتعلق بالقرارات القضائية بالصيغة التنفيذية. في حين بالنسبة لتنفيذ القرار، فإن مبدأ الفصل بين السلطات يستبعد أن يقوم القاضي بتنفيذ قراراته بنفسه، حيث يمكنه فقط أن يأمر بتنفيذه من قبل الإدارة. و لذلك، فإن التنفيذ القسري للقرارات يظل من اختصاص السلطة التنفيذية، وهو اختصاص ينشأ عن الصيغة التنفيذية بالنسبة للقرارات القضائية، واختصاص يمنع من حيث المبدأ في غياب تفويض قضائي فيما يتعلق بالقرارات الإدارية ذاتها. وفي نهاية المطاف، يتطلب تنفيذ القرار تعاون السلطات: الإدارة تحتاج إلى الصيغة التنفيذية للجوء إلى التنفيذ القسري، والصيغة التنفيذية تحتاج إلى الإدارة لكي تتحقق. Defining itself as “the action of putting the law into practice”, the execution irrigates the whole of public law (executive power, execution of laws, enforced execution, enforceable decision, etc.). However, it appears that the title of execution must be distinguished from its exercise. If the execution title is intrinsic to any court decision, it is because it is consubstantial to the existence of any decision but it is reinforced with regard to court decisions by the enforcement formula. As for the exercise of execution, the separation of powers excludes self-execution of its decisions by the judge, who can only order its execution by the administration. Consequently, the enforcement of decisions always falls within the competence of the executive branch, a competence deriving from the enforceable formula for judicial decisions, which is in principle prohibited without judicial authorization for its own decisions. In the end, the exercise of execution requires the collaboration of the Powers: the administration needs the enforcement formula to resort to enforcement, but the enforcement formula needs the administration to be carried out.
