ضمانات المستثمر الأجنبي المتعلقة بالحوافز المالية على ضوء القانون الجزائري

الملخص
يكتسي موضوع ضمانات المستثمر الأجنبي المتعلقة بالحوافز المالية أهمية بالغة كونه يعتبر المحور الرئيس الذي تدور من حوله جميع تشريعات الاستثمار والاتفاقيات الدولية المبرمة في هذا الصدد ،والتي بدورها تنعكس على الحوافز المالية من أجل معرفة فاعليتها في جلب الاستثمار الأجنبي ،وعلى الرغم من تقديم العديد من الضمانات التشريعية الموجهة للاستثمار الأجنبي بوجه عام وبالخصوص ما يهدف إلى حماية ملكية المستثمر الأجنبي كضمان ثان ،ومن أبرزها أيضا الضمانات الاتفاقية التي تمنحها الدولة المضيفة للمستثمر الأجنبي حيث يعتبره البعض شرطاً أساسيا لجلب رؤوس الأموال الأجنبية ،كما أن التعويض نتيجة لممارسة الدولة لحقها جبراً للأضرار ،شكّل ضمانات إضافية للمستثمر الأجنبي. The subject of guarantees Foreign investor guarantees related to financial incentives importance as it is considered the main axis around which all investment legislation and international agreements concluded in this regard revolve, which in turn are reflected in financial incentives in order to know their effectiveness in attracting foreign investment. Despite the provision of many legislative guarantees directed at foreign investment in general, and in particular what aims to protect the ownership of the foreign investor as a second guarantee, the most prominent of which are also the contractual guarantees granted by the host country to the foreign investor, as some consider it a basic condition for attracting foreign capital, as well as compensation as a result of the state exercising its right to compensate for damages, which constitutes additional guarantees for the foreign investor.
