الملخص
تعتبر الأهلية العنصر والركن الركين الهام لبناء إرادة الأشخاص الطبيعية أو المعنوية، بحيث تجعله يعبر ويفصح عن إرادته وفق ما يرتب عليه القانون من آثار، مما يترتب عليه اكتساب حقوق وتحمل إلتزامات،و باعتبار أن القانون التجاري فرع من فروع القانون الخاص، فإن المشرع وضع لأهلية الشخص الطبيعي التجارية أحكاما، بعضها يستلزم منا الرجوع للقواعد العامة الواردة في القانون المدني، والبعض الآخر مجالها القانون التجاري خاصة منها الأحكام الخاصة، وفي ضوء هذا جاءت فكرة المقال لإلقاء نظرة عن الأحكام القانونية الأهلية التجارية للشخص الطبيعية في التشريع الجزائري. Capacity is considered the important element and pillar of building a person’s natural or moral will, so that it makes him express and disclose his will in accordance with the effects of the law, which results in acquiring rights and bearing obligations, and considering that commercial law is a branch of private law, The legislator has established provisions for the commercial capacity of a natural person, some of which require us to refer to the general rules contained in the civil law, and others are within the scope of commercial law, especially the special provisions. In light of this, the idea of the article came to take a look at the legal provisions on the commercial capacity of a natural person in Algerian legislation.
