Abstract: This article discusses a problem raised by some Orientalists. It is the thesis that Islam in general and Islamic jurisprudence in particular is a system of duties. This thesis states that Islam overwhelms the individual with duties and does not grant him any rights. The present study is devoted to essential questions such as: where did the scholars of usūl al-fiqh discuss the concept of Right? Can it be inferred from the emphasis on “duty” as one of the five Shari'ah rules that Right is neglected and that the system of Islamic jurisprudence is based on duty? The main research question discussed below is whether the rights of God take precedence over the rights of the individual in Islam. It has been shown that the emphasis on the concept of duty in Islamic jurisprudence is an emphasis on the preservation of the rights inherent in duties. It cannot be said that the rights of God come before the rights of the individual and vice versa, because Islam aims to protect the interests of the individual and society simultaneously.
