ثنائية السلطة التنفيذية وفق التعديل الدستوري الثالث عشر لسنة 2023م

الملخص
ملخص: تركز الدراسة على تناول موضوع السلطة التنفيذية باعتبارها أحد أهم السلطات في الدولة، وفق هندسة المشرع الليبي لها من خلال التعديل الدستوري الثالث عشر 2023م، الذي حرص على تنظيمها بشكلٍ مختلفٍ عن السابق، وفق تصميمٍ جديدٍ يعتمد نظام الثنائية، بعد أن فشلت كل المحاولات السابقة في إفراز نظامٍ سياسيٍ يكون ملائمًا للحالة الليبية؛ تنبثق عنه سلطة تنفيذية تكون قادرةً على تسيير المرحلة الانتقالية القادمة، وتستطيع إعادة هيكلة مؤسسات الدولة، بشكلً يؤدي إلى بناءٍ متينٍ تقوم عليه الدولة، ويحقق الاستقرار. Abstract: The study focuses on addressing the issue of executive authority as it is one of the most important authorities in the state, according to the Libyan legislator’s engineering of it through the thirteenth constitutional amendment in 2023 AD, which was keen to organize it differently than before According to a new design that adopts the bilateral system, after all previous attempts failed to produce a political system that is appropriate for the Libyan situation. An executive authority will emerge from it that will be able to manage the next transitional phase, and will be able to restructure state institutions, in a way that leads to a solid building on which the state will be based and achieve stability.
