الملخص
يهدف البحث إلى توضيح حكم المُنَشِّط، والمخدر، والمسكر، بشكل عام، وحكم القات، والكفتة، والحشيشة، والأفيون على وجه الخصوص، والتعريف بالفقيه الإمام ابن زياد كفقيه شافعي يمني محقق، قدم خدمة للمذهب الشافعي خاصة، وللمكتبة الإسلامية بصفة عامة، وبيان آرائه واختياراته في رسالته، وتوضيح منهجه، وذكر مصادره ومراجعه، وقد قسمت البحث إلى قسمين؛ القسم الأول للدراسة، وفيه مبحثان، المبحث الأول: تحدثت فيه عن حياة المؤلف: اسمه، ونسبه، ومولده، ووفاته، وشيوخه، وتلامذته، ومذهبه، وآثاره العلمية ومصنفاته. وفي المبحث الثاني: خصصته لدراسة الكتاب، فحققت اسم الكتاب وأثبت نسبته إلى مؤلفه، وذكرت المصادر التي اعتمد عليها المؤلف في كتابه، وبينت منهجه فيه، ووضحت آرائه واختياراته، ومنهجي في التحقيق، ووصف نسخ المخطوط. والقسم الثاني: خصصته لتحقيق النص تحقيقاً علمياً، والتعليق عليه بما يخدم النص المحقق، ويخرجه على الصورة التي أرادها المؤلف، ثم الخاتمة التي ذكرت فيها أهم النتائج التي توصلت إليها والتوصيات. Research summary: The research aims to clarify the rule of stimulants, narcotics, and intoxicants in general, and the rule of qat, kofta, hashish, and opium in particular, and to introduce the jurist Imam Ibn Ziyad as a Yemeni Shafi’i jurist and investigator. And clarification of his approach, and mentioning his sources and references. The research was divided into two parts. The first section contains two topics. The first topic: I talked about the life of the author, his name, lineage, birth and death, his sheikhs, his students, his doctrine, his scientific works and his works. In the second topic: I devoted it to the study of the book, so I verified the name of the book and proved its attribution to its author, and mentioned the sources on which the author relied in his book and explained his method in it, and clarified his opinions, choices, and methodology in investigation, and described the copies of the manuscript. The second section: I devoted it to the scientific investigation of the text, and commenting on it in a way that serves the investigated text, and brings it out in the image that the author wanted, then the conclusion in which I mentioned the most important results that were reached and recommendations..
