الملخص
نظرا لأهمية البيئة البحرية في حد ذاتها فإن موضوع حماية البيئة البحرية واحد من بين أهم الموضوعات التي ظهرت مؤخرا وبقوة على الساحة القانونية ، و التي أضحت تمثل اقتصاديات العالم، كونها تعد من أفضل الطرق وأيسرها، و نظرا لهذه الأهمية ولكون مشكلة التلوث البحري قضية عالمية تتطلب تضافر كافة الجهود، ظل المشرع الجزائر يسعى لجهود رامية لحماية البيئة البحرية من التلوث ، على غرار تلك الجهود التي سعت إليها الاتفاقيات الدولية وغيرها إلى إبرام اتفاقية عامة لحماية البيئة البحرية من جميع مصادر التلوث والمتجسدة في اتفاقية الأمم المتحدة وقد انعكست كل تلك الجهود على المستوى الوطني وهذا بسن المشرع الجزائري قواعد قانونية وقائية وردعية ترمي لحماية البيئة البحرية من الأضرار الناجمة عن التلوث الذي أحدثه الإنسان نتيجة عبثه بتلك البيئة واستغلالها استغلالا سيئا. Given the importance of the marine environment in itself, the issue of protecting the marine environment is one of the most important issues that have recently emerged and strongly on the legal scene, Which has become the world’s economy, as it is one of the best and easiest ways, and given this importance and the fact that the problem of marine pollution is a global issue that requires concerted efforts of all, the Algerian legislator sought efforts to protect the marine environment from pollution, similar to those efforts sought by international conventions And others to the conclusion of a general agreement to protect the marine environment from all sources of pollution embodied in the United Nations Convention. All these efforts were reflected at the national level, and this was enacted by the Algerian legislator, preventive and deterrent legal rules aimed at protecting the marine environment from the damage caused by pollution caused by man as a result of his tampering with that environment and its exploitation badly exploited.
