دوافع المطالبة بتطبيق العقوبات الشرعية.

الملخص
من واجب المسلم تطبيق الشريعة، والاحتكام إلى مبادئها واحكامها التشريعية، سواء في العبادات أو في المعاملات أو المناكحات والعقوبات، والأقضية والشهادات، وفي الوقت الحالي من واجب العلماء والباحثين المطالبة بذلك، بدافع العقيدة والإيمان، وكذا يقينية لا صلاح للبشرية في معارضة الشريعة، تأتي هذه الدراسة تبين الدوافع التي تجعل المسلم يطالب بتطبيق أحد فروع الشريعة وهي الحدود والعقوبات الشرعية، لأجل بيان مميزات ووظائف هذه العقوبات (مطلب أول)، وكذا التركيز على فشل العقوبات التي تقررها القوانين الوضعية من خلال الممارسة والواقع المعيش (مطلب ثاني) It is the duty of a Muslim to apply the Shari'ah, and to refer to its principles and legislative provisions, whether in worship, transactions, marriages, punishments, judgments and testimonies, and at the present time it is the duty of scholars and researchers to demand this, out of the motivation of faith and belief, as well as the certainty that there is no good for mankind in opposing the Shari'ah, this study comes to show the motives that make a Muslim demand the application of one of the branches of the Shari'ah, namely the limits and legal penalties, in terms of explaining the advantages and functions of these penalties (first chapter), in addition to focusing on the failure of the sanctions decided by positive laws through practice and living reality (second chapter(
