Authors : Bekhouche Imed Eddine .

Abstract

In addition to serving as a regulatory tactic to monitor and improve regulatory compliance, registration in the franchising industry also makes data and statistic collection easier. What are the primary legal concerns surrounding registration in Algeria, and what are the stakeholders' current practices regarding registration under franchise business in Algeria? Examining registration-related legal framework issues and analysing current stakeholder practices in Algerian franchise business registration are the main goals of this study. The method employed was the doctrinal legal approach combined with qualitative interviewing. The method used to gather the data was the armchair library method. The results demonstrate that: in Algeria, there is no requirement or procedure to register a business as a franchise during the registration phase, which leaves the industry devoid of information and a clear picture. The current procedure involves a franchisee registering after negotiating and signing a contract with the franchisor. The agreement will not be deemed a franchise. Subsequently, the franchisee registers as a new company with the Algerian Register of Commerce using that contract. Even if the franchise agreement was with a foreign franchisor, the franchisee registers his company as completely Algerian. The findings also demonstrate that there are important advantages to registration in the franchising industry.
