الإستثناءات الواردة على مبدأ حظر إستعمال القوة أو التهديد بها قي ظل القانون الدولي Exceptions To The Prohibition Of The Use Or Threat Of Force Under International Law

الملخص
الملخص: أٌعتبرَ من أهم نجاحات المجتمع الدولي بعد الحرب العالمية الثانية ، هو التمكن من إنشاء ميثاق للأمم المتحدة ينظم العلاقات الدولية ويقوم على مبادئ أساسية، وأولها عدم استخدام القوة في العلاقات الدولية، ووضع قواعد استثنائية بما يتماشى ومقاصد الأمم المتحدة المبنية على المساواة في السيادة وعدم التدخل في الشؤون الداخلية للدول، ما أدى إلى عدم تحريم استخدام القوة بصفة مطلقة، ونص الميثاق بالحق الطبيعي للدول للدفاع عن أنفسهم بصفة فردية أو جماعية في حالة التعرض للاعتداءات العسكرية، كما يمكن وضع تدابير للأمن الجماعي، مع احترام الضوابط الأساسية للحفاظ على السلم والأمن الدوليين. لكن بعض الممارسات الدولية فتحت المجال لاستعمال القوة وتجاوز تلك الاستثناءات مما أضحى يشكل عدم استقرار، فيصبح من الضروري وضع حدود وفقا للشرعية الدولية. Abstract: After World War II, the establishment of the United Nations Charter was considered one of the most significant achievements of the international community, which regulates international relations and is based on fundamental principles. Foremost among these is the non-use of force in international relations and the establishment of exceptional rules in line with the purposes of the United Nations, based on equality in sovereignty and non-interference in the internal affairs of states. This has led to the non-absolute prohibition of the use of force, with the Charter affirming the natural right of states to defend themselves individually or collectively in case of military aggression. Collective security measures can also be implemented while respecting the basic controls for maintaining international peace and security. However, some international practices have opened the door to the use of force and bypassed those exceptions, leading to instability, thus, it has become necessary to set limits in accordance with international legitimacy.
