الملخص
الملخص: يعد المعمار وبناء العقارات أحد اهم مظاهر التطور البشري التي مكنت الإنسان من توفير المسكن المناسب له ، وكذلك فتح باب الاستثمار العقاري في الأبنية كالعقارات المرتفعة و كالابراج الشاهقة. مما أفرز الحاجة إلى الملكية العقارية المشتركة التي يتعدد فيها ملاك العقار الواحد. وبرزت مشكلة البحث في أن العقار المشترك الملكية بحاجة للحماية اكثر من العقار الذي يكون مالكه شخص واحد. ومن هنا ظهرت أهمية البحث التي تركزت في تحقيق أهدافه من تحديد المركز القانوني للمالك ، أو الملاك في العقار مشترك الملكية. واتبع البحث منهج استقرائي تحليلي في المركز القانوني للمالك، أو مجموع الملاك المشتركين في الملكية العقارية ؛ وعليه ظهرت عدة نتائج أهمها أن المركز القانوني للمالك يتأتى من مناقشة مجموعة حقوق ، وعدة واجبات قانونية ملزمة في الملكية المشتركة، وأن الملكية المشتركة للعقار تعمل على ابراز دور الملاك في حفظ العقار، كما اهم الانتفاع به كل حسب نسبته ووحدته مفرزة أو غير مفرزة Abstract: Architecture and real estate construction are one of the most important aspects of human development that enabled man to provide suitable housing for himself, as well as opening the door to real estate investment in buildings such as high-rise buildings and skyscrapers. This created the need for joint real estate ownership in which the owners of one property are multiple. The research problem emerged in that jointly owned real estate needs more protection than a property whose owner is one person. Hence, the importance of the research emerged, which focused on achieving its objectives of determining the legal status of the owner, or the owners in jointly owned real estate. The research followed an analytical inductive approach in the legal status of the owner, or the group of joint owners in real estate ownership; Accordingly, several results emerged, the most important of which is that the legal status of the owner comes from discussing a group of rights, and several binding legal duties in joint ownership, and that joint ownership of the property works to highlight the role of the owners in preserving the property, as well as the most important benefit from it, each according to its proportion and unit, separated or not separated:: , , ,
