القواعد الشرعية وتطبيقاتها الفقهيَّة في ميدان العمل الخيري

الملخص
ملخص: يحاول هذا البحث جمع أهم القواعد الفقهية والمقاصدية الحاكمة لميدان العمل الخيري، والتي ينبغي الاحتكام إليها والسَّير في ظلها بغية تنظيمه وترشييده، ومن ثَمَّ تحقيق مقاصده وجني الثمار المرجوة منه؛ وذلك من خلال التعريف بهذين النوعين من القواعد, وكذا التعريف بالعمل الخيري, ثم إيراد هذه القواعد وأبرز ما يتفرع عنها من مسائل فقهية عملية في هذا المجال, وكان الإشكال الرئيس في هذه الدراسة هو: ما أهم القواعد الفقهية والمقاصدية التي ينبغي الاحتكام إليها في مجال العمل الخيري؟ وخلص البحث إلى أنه لابدَّ لنجاح العمل الخيري وتحقيق أهدافه وغاياته أن ينضبط بالقواعد والضوابط الشرعية, وإلَّا كان مخالفا لمقاصد الشارع؛ من جلب المصالح وتكثيرها، ودرء المفاسد وتقليلها, وغيرَ محقق للنتائج المرجوة منه. Abstract: This research tried to collect the most important jurisprudential (fiqh rules) and purposes rules that guide charity and volunteering work which should be under its control and guidance in ordre to be more organized rationalized in such way will gain its objectives and purposes, therefore this study will define the two kind of rules (fiqh & purposes) also deals with charity work definition then look at those rules subdivision fiqh cases. My main problematic in this research is to explain the most important fiqh and purposes rules that should guid charity and volunteering work. The research concluded that for the success of charitable work and the achievement of its goals and objectives, it must be regulated by Sharia rules and controls, otherwise it would be contrary to the purposes of the law. It brings benefits and increases them, and prevents and reduces harms, and does not achieve the results expected from it.
