الملخص

اثر التطور التكنولوجي في مجال الاتصال على المجال القضائي إذ أصبحت المحاكمات الجزائية تتم عن بعد باستعمال تقنية الاتصال المرئي في الظروف التي تقتضي احترام ألآجال المعقولة للنظر في القضية ، غير أن استعمال تلك التقنية أمام محكمة الجنايات أثار العديد من الإشكالات المتعلقة بضمانات المحاكمة العادلة سيما أن تلك المحكمة تتميز بصرامة في إجراءاتها و شدة في أحكامها في حال الإدانة و كذا خصوصية من ناحية تشكيلها من قضاة محترفين و محلفين و طبيعة تكوين قناعتها حول الاتهام دون حاجة لتقديم كشف حساب عن ذلك ، فلذلك كانت المطالبات بين استثناء المحاكمة الجنائية من تقنية المحادثة المرئية بحيث تنعقد وفقا للطريقة الكلاسيكية و بين السماح باللجوء لتلك التقنية أمامها لكن مع توفير مزيد من الضمانات تكريسا لحقوق الإنسان و المحافظة على المبادئ الأساسية للمحاكمة المنصفة و هذه الدراسة ترمي لمعالجة مسالة تأثير استعمال تقنية المحادثة عن بعد على ضمانات المتهم أمام محكمة الجنايات في التشريع الجزائري The impact of technological advancements in the field of communication on the judicial system has led to criminal trials being conducted remotely using video communication technology, particularly in circumstances that necessitate respecting reasonable time limits for case consideration. However, the use of this technology in criminal courts has raised numerous issues related to the guarantees of a fair trial, especially since these courts are characterized by strict procedures and severe penalties in the event of a conviction. Additionally, they have a unique composition consisting of professional judges and jurors, and the nature of how they form their convictions regarding the accusation does not require them to provide an account of that process. Consequently, there have been calls either to exempt criminal trials from video communication technology, allowing them to proceed in the traditional manner, or to permit the use of this technology while ensuring additional guarantees to uphold human rights and maintain the fundamental principles of a fair trial. This study aims to address the issue of the impact of using remote communication technology on the guarantees of the accused before criminal courts in Algerian legislation.
