The Phenomenon Of Spouses’ Tendency To Determine The Sex Of The Fetus- A Legal Study- ظاهرة نزوع الأزواج إلى تحديد جنس الجنين- دراسة شرعية-

Abstract

This research deals with a contemporary medical issue, which is the determination of the sex of the fetus from Shari’a standpoint. This phenomenon has become a refuge for many spouses, whether they need it or not. The research aims to make them learn about the ruling of the phenomenon and the shari'a controls governing it if it is permissible. Therefore, we based the research on an introduction; which included definition of the topic and its issue… and two main headings; the first to introduce the phenomenon of sex determination, its history, medical and other means used in this regard, the second for the ruling of sex determination and its controls, then we concluded with the most important results; including the agreement of the scholars to prevent the determination at the level of countries and societies; because it leads to a violation of the laws of the universe, but they deffered on it at the level of individuals. يتناول البحث قضية طبية معاصرة تتمثل في تحديد جنس الجنين من الناحية الشرعية، حيث أصبحت هذه الظاهرة ملاذا للكثير من الأزواج ممّن تدعوهم الحاجة لذلك أو لا، ويهدف البحث إلى تعريفهم بموقف الشرع من هذه النازلة، وكذا الضوابط الشرعية الحاكمة لها حال الجواز، وعليه أقمنا البحث على مقدمة؛ اشتملت على التعريف بالموضوع وإشكاليته... وعنوانين رئيسين؛ الأول للتعريف بظاهرة تحديد الجنس وتاريخها والوسائل الطبّية وغيرها المتبعة في ذلك، والثاني لحكم تحديد الجنس شرعا وضوابطه، ثم أنهينا البحث بخاتمة ضمنّاها أهم نتائجه؛ منها اتفاق العلماء على منع التحديد على مستوى الدول والمجتمعات؛ لأنه يؤدي إلى الإخلال بنواميس الكون، واختلفوا فيه على مستوى الأفراد.
