ملخص: يهدف البحث إلى بيان أثر التعليق على شرط في عقود المعاوضات والتمليكات على وجه الخصوص؛ وذلك بإيضاح صوره، وذكر أقوال الفقهاء وحكمهم عليها ومناقشة أدلة التعليق المختلف في حكمه جوازا وعدما للتوصل إلى الراجح منها، ويسلط البحث الضوء على إبراز أهم المسائل المتعلقة بالبيع بالتقسيط واستخراج ما له ارتباط بشروط التعليقات؛ سواء كانت صريحة أو متضمنة، مع بيان ما يصح التعليق به في عقد البيع بالتقسيط وما لا يصح، وما يحتاج إلى ضوابط حتى يتسنى استعماله. وخلص البحث بعد مناقشة أدلة الفقهاء إلى ترجيح جواز تعليق العقد في البيع بالتقسيط شرط توفر الضوابط الشرعية التي يجب ألا تنفك عنه حتى تترتب آثاره في إطار مشروع، كما تبين أن البيع بالتقسيط ينطوي على مسائل كثيرة يسعها التعليق؛ حيث صيرها إلى مسائل مشروعة بعد أن كان الريب لا يفارقها، وهذا عين أثر التعليق في العقد. Abstract : The research aims to show the effect of suspension on a condition in the contracts of exchange and ownership in particular by clarifying its forms, stating the opinions and judgments of the jurists about them, and discussing the evidence of suspension whose ruling is disputed, whether permissible or not, in order to reach the most probable ones. The research highlights the most important issues related to instalment sale and extracts all of explicit and implicit suspension conditions, with indication of what is valid and not valid to suspension in the instalment sale contract and what needs regulations in order to use it. The research concluded, after discussing the evidence of the jurists, to favour the permissibility of suspension of contract in the instalment sale, provided that the legal controls are available and must not be separated from it until its effects arise within a legitimate framework. It was also found that the instalment sale involves many issues that can be suspended, as it turned them into legitimate ones after they were always uncertain, and this is the true effect of suspension in the contract.
