ارتباط حق البناء والتعمير بحق ملكية الأرض

الملخص
عملية تعمير الأرض وبناءها مرتبط بالأساس بملكية العقار المراد البناء عليه، و هو ما أكدته المادة 50 من القانون 90-29 المؤرّخ في 01/12/1990 المتعلّق بالتهيئة والتعمير: "حق البناء مرتبط بملكية الأرض"، و حسب هذه المادة حق البناء من أوجه حق الملكية العقاريــة. Summary: The process of land reconstruction and construction is essentially linked to the ownership of the property on which it is to be built, and this is confirmed by Article 50 of Law 90-29 dated 12/01/1990 relating to development and reconstruction: “The right to build is linked to ownership of the land,” and according to this article the right to build is one of the aspects Real estate ownership right.
