الفاعل المعنوي في التشريع الإماراتي "دراسة تحليلية"

الملخص

ملخص: تناولت الدراسة مفهوم الفاعل المعنوي في التشريع الإماراتي، فاستعرضت في المبحث الأول فكرة الفاعل المعنوي ودوره في الجريمة، والنظرية الشخصية للمساهمة الجنائية، وتصنيفه كمساهم أصلي في الجريمة وتعدد الفاعلين المعنويين في الجرائم، وفي المبحث الثاني، استعرضت الدراسة أركان جريمة الفاعل المعنوي في التشريع الإماراتي، وخلصت الدراسة إلى أن الفاعل المعنوي يلعب دورًا رئيسيًا في التخطيط للجريمة، دون قيامه بالفعل المادي مما يعد تطورًا قانونيًا في مفهوم المسؤولية الجنائية، وأوضحت اختلاف تعامل التشريعات مع مفهوم الفاعل المعنوي، فبعضها يتضمن تعاريف صريحة له، بينما يوجد نقص في التشريع الإماراتي بخصوص تعريف الفاعل المعنوي ودوره ومسؤوليته، واقترحت الدراسة ضرورة صياغة تعريف واضح للفاعل المعنوي وتوسيع النصوص القانونية أو إضافة مادة جديدة في القانون الإماراتي لتجنب التفسيرات المتباينة، وتحديد مسؤوليته ووضع العقوبات المناسبة له. الكلمات المفتاحية: الفاعل المعنوي، الفاعل الأصلي، المنفذ المادي، التحريض، المساهمة الجنائية. Abstract: The study addressed the concept of the moral actor in UAE legislation. In the first section, it examined the idea of the moral actor and its role in the commission of a crime, as well as the personal theory of criminal contribution and its classification as a primary contributor to the crime, and the multiplicity of moral actors in crimes. In the second section, the study explored the elements of the crime of the moral actor in UAE legislation. The study concluded that the moral actor plays a significant role in the planning of the crime, even without engaging in the physical act, which represents a legal development in the concept of criminal responsibility. It also highlighted the variation in how different legislations deal with the concept of the moral actor, with some including explicit definitions, while there is a deficiency in UAE legislation regarding the definition, role, and responsibility of the moral actor. The study proposed the necessity of formulating a clear definition of the moral actor and expanding the legal texts or adding a new provision in UAE law to avoid divergent interpretations, specify their responsibility, and impose appropriate penalties.
