لجان مراجعة القوائم الانتخابية كآلية لتجسيد مبدأ حياد الإدارة

الملخص
الملخص: تعد الانتخابات الطريقة المثلى لتجسيد الديمقراطية وممارسة السلطة عن طريق ممثلي الشعب المنتخبين، ولهذا كان من الضروري البحث عن أنجع الطرق لضمان جديتها. تمر الانتخابات بمراحل متعددة انطلاقا من مراحلها التحضيرية ولاسيما خلال مرحلة حصر قائمة الناخبين، حيث أسند المشرع مهمة مراجعة قوائم الناخبين إلى جهات محايدة تتمثل في لجان مراجعة القوائم الانتخابية التي يرأسها القضاة وذلك تحت إشراف السلطة المستقلة للانتخابات، كما مكنها من سلطة الفصل في طلبات التسجيل والشطب من القوائم الانتخابية، وأتاح إمكانية الطعن في أعمالها عن طريق التظلم وعن طريق الطعن القضائي. يهدف هذا المقال إلى توضيح مدى حياد الإدارة خلال مرحلة الاعداد للانتخابات، وأن البحث عن مصداقيتها جعل المشرع يشرك سلطة القضاء في هذه العملية تحت إشراف السلطة المستقلة للانتخابات، غير أن اهتمام المشرع بالجوانب الموضوعية جعله يتغافل عن جوانب شكلية مهمة في ضمان حياد عمل هذه اللجان. Abstract: Democracy is the ideal way for the exercise of power by the people through their elected representatives, therefore it was necessary to search for the most effective ways to ensure its seriousness. Elections go through multiple and complex stages, especially during the stage of counting the voter list. Where the legislator assigned the task of reviewing voter lists to neutral parties it consists of electoral lists review committees headed by judges and under the supervision of the independent election authority. It also gave it the authority to decide on applications for registration and removal from electoral lists. It provides the possibility of challenging its work through grievances and judicial appeals. This article aims to clarify the extent of the administration’s neutrality during the preparation stage for the elections. And the search for its credibility made the legislator involve the judiciary in process under the supervision of the independent election authority. However, the legislator’s interest in objective aspects made him ignore important formal aspects in ensuring the neutrality of the work if these committees.
