الصـــــــــــــراع الــــــــــدولي وتحقيــــــــق الأمـــــن الجــــماعي الــــــــــدولي

الملخص

تُعدُّ الحروب والنزاعات المسلحة من المظاهر الاجتماعية التي أثرت على حياة الإنسان وحقوقه عبر التاريخ، وعانت الإنسانية منها، إذ تؤدي إلى تدمير الأسر وتفكك المجتمعات لما تسببه من نتائج مأساوية على حقوق الإنسان ومدى شرعيتها، وكان للحرب وما زال الأثر الكبير في حياة الشعوب والحضارات بحسب إتساع رقعتها ومدى أثرها وتطور أسلحتها وأهدافها التي نشبت من أجلها، واختلف التأثير على حقوق الإنسان من عصر وأمة إلى أخرى، وتعدّ جرائم الحروب قديمة قدم الإنسانية لذلك سعت الشعوب للبحث عن الطرق والتشريعات التي تخفف وطأتها وتقلل آثارها والعمل على منع وقوعها إذا تمكنت، من خلال المحاكمات الدولية وإيقاع العقوبات على مرتكبي تلك الجرائم. وتعددت مفاهيم الحرب والقانون الدولي عند فقهاء القانون الدولي تضيق وتتسع بحسب أهدافها وتطور قواعدها؛ لذلك ليس من السهل الاتفاق على مفهوم واحد أو التوفيق بين فقهاء القانون على ذلك ووضع قواعد ثابتة للحرب بحسب طبيعة الصراعات التاريخية أسبابها الاقتصادية أم السياسية أم صناعية. ومآسي الحروب والنزاعات المسلحة الدولية وغير الدولية وجعلت منه أداة للخراب والدمار، وهذه حقيقة واقعية؛ لأن الحروب لا تفرق بين المنتصر والمنهزم، ونظراً لما يترتب عليها من إنعكاسات على المستوى الدولي وتداعيات على الأمن والسلم الدوليين، برزت فعاليات على الساحة الدولية والمنظمات الدولية والإقليمية تعمل على تسويتها بمختلف الوسائل والآليات السلمية منها والقسرية، بحسب اختلاف أشكالها من حيث خصائصها ومستوياتها وحدتها، فاختلفت المعايير والجهود الدولية في كيفية التعامل معها بغية إحصائها أم التحكم فيها أم حلها وتسويتها. الكلمات المفتاحية: النزاع الدولي - تحقيق الأمن - الأمن الدولي. Abstract: Wars and armed conflicts are among the social manifestations that have affected human life and rights throughout history, and humanity has suffered from them, as they lead to the destruction of families and the disintegration of societies because of the tragic results they cause on human rights and the extent of their legitimacy. Its area, the extent of its impact, the development of its weapons and the goals for which it arose, and the impact on human rights differed from one era and one nation to another, and war crimes are as old as humanity, so people have sought to search for ways and legislation that mitigate their impact and reduce their effects and work to prevent their occurrence if they can, through trials and imposing penalties on the perpetrators of these crimes. There are many concepts of war and international law among the jurists of international law, narrowing and expanding according to its objectives and the development of its rules. Therefore, it is not easy to agree on a single concept or to reconcile legal scholars on that and to establish firm rules for war according to the nature of historical conflicts, whether their economic, political or industrial causes. The tragedies of international and non-international wars and armed conflicts have turned him into a tool of ruin and destruction, and this is a realistic fact. Because wars do not differentiate between the victor and the defeated, according to their different forms in terms of their characteristics, levels, and unity. International standards and efforts differed in how to deal with them in order to count them, control them, or solve and settle them .
