الملخص
الحدود الشرعية هي قوانين عادلة وعامة تطبق على جميع الناس الغني والفقير والقوي والضعيف والناس يمكنهم أن يتعافوا الحدود فيما بينهم قبل بلوغها إلى الحاكم، ولقد استطاعت الحدود الشرعية أن تنقذ الجناة من درك المعاصي والجرائم ليتوبوا إلى الله عز وجل وليصبحوا أفراداً صالح ين في المجتمع المسلم مما يدل على أن العقوبة في الإسلام ليس الغرض منها التعذيب كما يدعي العلمانيون وغيرهم من أعداء الإسلام، وإنما الغرض منها تأهيل المذنبين، وإنقاذهم من مستنقع الجريمة والذنب إلى عالم التوبة الفسيح، وقد حث الإسلام على التوبة بعد أن تقام عليهم الحدود حتى يفوزوا بمغفرة الله ورضوانه. فقد شرع الله حد القذف حماية لأعراض المحصنات، وحفظاً للمجتمع المسلم من أن تشيع فيه الفاحشة، وتطهيراً للقاذف من الذنب الذي ارتكبه ، لأن القاذف غيره بالزنى لا سبيل للناس إلى العلم بكذبه، فجعل حد الفرية تكذيباً له ، وتبرئة لعرض المقذوف ، وتعظيما ً لشأن هذه الفاحشة التي ُيُجلد من رمى بها مسلما ً ، ولا يقتصر ضرر القذف على المقذوف وحده ، بل يلحق أهله وأولاده وقبيلته.
