حق الهجرة من منظور الشريعة الاسلامية

الملخص

تمثل الهجرة تحدياً خطيراً للمجتمعات العالمية ، مما يستدعي لفت الإنتباه خاصة لبعض الجوانب المتعلقة بالمهاجرين .إذ شهد القرن العشرين حضوراً دولياً بالإهتمام والتدقيق لمشكلة الهجرة القسرية التي تسمى: بالهجرة القسرية . إذ يمكن أن تجتمع العديد من العوامل الدافعة إلى التهجير منها : الكوارث الطبيعية من صنع الإنسان أو عوامل عرقية ودينية وسياسية مما يحدث ازاحة المدنيين من أماكن تواجد إقامتهم إلى مكان أكثر أمناً مما يميزه عن الهجرة الطوعية الإقتصادية ... فقد ظلت إحتياجات المهاجرين داخلياً وخارجيا حتى وقت قريب تلقى تلبية غير كافية من جانب الاستجابة الإنسانية الدولية، أما الوقت الحاضر فيلاقي المهاجرين داخلياً وخارجيا أشكالا عدة من الحرمان والظلم . إنّ أهمية الموضوع المتمثل بالحماية الشرعية للمهاجرين ومنع الانتهاكات المتكررة في حقهم واجبارهم على ترك مكان إقامتهم داخل أوطانهم وتعرضهم إلى شتى المخاطر ، وأنّ محنة النزوح في الآونة الأخيرة التي طالت العالم عموماً وفي العراق خصوصاً تستلزم جهوداً دولية كبيرة من قبل الحكومات والمنظمات الدولية والمنظمات الغير حكومية لتلبي إحتياجات هذه الفئة المتضررة من الصراعات المسلحة والسياسات . Research Summary Migration represents a serious challenge to global societies, which calls for attention, especially to some aspects related to immigrants. The twentieth century witnessed an international presence with attention and scrutiny of the problem of forced migration, which is called: forced migration. Many factors driving displacement can be combined, including: man-made natural disasters or ethnic, religious and political factors, which cause the displacement of civilians from their places of residence to a safer place, which distinguishes it from voluntary economic migration... Until recently, the needs of migrants, internally and externally, remained insufficiently met by the international humanitarian response. At the present time, internal and external migrants face many forms of deprivation and injustice. The importance of the issue represented in the legitimate protection of migrants and the prevention of repeated violations against them and forcing them to leave their place of residence within their countries and exposing them to various risks, and that the ordeal of displacement in recent times that affected the world in general and in Iraq in particular requires great international efforts by governments, international organizations and non-governmental organizations to meet The needs of this group affected by armed conflicts and policies
