العدالة المناخية: من الإطار النظري إلى الممارسة القضائية

تعد مشكلة تغير المناخ شاغلا مشتركا للإنسانية بالنظر إلى آثاره الضارة على البيئة البشرية، مما حفّز المجتمع الدولي على إنشاء آليات مؤسسية وقانونية لمكافحة هذه الظاهرة، بيد أنها تفتقر إلى الفعالية المطلوبة للتخفيف من آثار الاحتباس الحراري، وأمام تفاقم الظاهرة برز دور المجتمع المدني الدولي في طرح المبادرات ومطالبة الحكومات والشركات باتخاذ التدابير الوقائية والعلاجية، معتمدة على المسلك القضائي، وبهذه الكيفية أثيرت فكرة العدالة المناخية للتعبير عن الحاجة إلى تحديد المسؤوليات عن تغير المناخ من خلال استهداف المصادر الرئيسية لانبعاثات غازات الدفيئة، والجهات المسؤولة عن سياسات المناخ، خاصة أن تقارير الهيئة الحكومية الدولية المعنية بتغير المناخ في مجال دراسة الاحتباس الحراري وتأثيراته تشير إلى عدم جدوى الحلول المقترحة، واستمرار الأضرار المهددة للنظم البشرية والطبيعية، ومن هذا المنطلق، تثار الإشكالية بشأن أسباب ظهور فكرة العدالة المناخية وكيفية تكريسها في العمل القضائي. The problem of climate change is a common concern of humanity in view of its harmful effects on the human environment, which has motivated the international community to establish institutional and legal mechanisms to combat this phenomenon, but they lack the effectiveness required to mitigate the effects of global warming, and in the face of the aggravation of the phenomenon has emerged the role of the international civil society in proposing Initiatives and requiring governments and companies to take preventive and curative measures, depending on the judicial process, and in this way the idea of climate justice was raised to express the need to define responsibilities for climate change by targeting the parties responsible for climate policies, especially since the reports of the Intergovernmental Panel on Climate Change indicate the futility of the proposed solutions, and the continuation of threatening damages to human and natural systems. The problem arises about the reasons for the emergence of the idea of climate justice and how to devote it to judicial work.
