تعاني البشرية منذ الازل من الجريمة، ورغم بساطة الجريمة في ذلك الزمان، وكونها تقليدية لم تستطع المجتمعات إيجاد المخرج منها، وإيقافها، والقضاء عليها، والقضاء على المجرمين، وبتطور الحياة البشرية تفنن المجرمون في الجُرم، وظهر ت أنوع جديد من الجرائم، وعلى رأسهم الجريمة الإرهابية. حاولت التشريعات، والفقه إيجاذ تعريف للجريمة الارهابيية لكنها لم توفق إلى حدا بعيد، لكون الجريمة الارهابية متعدد الاصناف، ولهذا نسلط الضوء عليها من خلال هذه الدراسة، ونخصص دراستنا على نوع خاص من الجرائم الارهابية، وهي جريمة اختطاف الطائرات، نين تعريفها من خلال بعض التشريعات، والفقهاء، ونتطرق إلى نظرة الشريعة الاسلامية لها، وابين صنفها وهل تعتبر الجريمة الارهابية من جرائم الحرابة Study Summary: Humanity has suffered from crime, crime at that time has simples and traditional. The societies could not find a way to stop it and eliminate criminals،and with the development of human life, criminals mastered the crime.And with the development of life Criminals committing crimes New types of crimes have emerged the most notably is the terrorist crime.I searched for Shania law and jurisprudence to define it, but it did not work to a large extent, terrorists’ crime has many types. Through this study, we shed light on it, and I am studying a special kind of it, which is the crime of hijacking planes, we know it through jurisprudence and legislation, and we look at the view of Islamic law, and are it classified as a crime of war?
