الموازنة بين آيتي نشوز المرأة ونشوز الرجل دراسة تحليلية في ضوء المقاصد القرآنية

Résumé
يتناول هذا البحث الموازنة بين آيتي نشوز المرأة ونشوز الرجل في القرآن الكريم، من خلال دراسة تحليلية في ضوء المقاصد القرآنية، بهدف الكشف عن أوجه الاتفاق والاختلاف بين منهجي القرآن في معالجة كل من الحالتين، وبيان الحكم والمقاصد التي يقوم عليها التشريع القرآني في الحفاظ على الأسرة وتحقيق الاستقرار الأسري. وتنبع أهمية البحث من معالجة قضية يكثر حولها الجدل، مع إبراز التكامل التشريعي بين الآيتين بعيدًا عن القراءة الجزئية أو المجتزأة للنصوص. واعتمد البحث المنهج التحليلي المقاصدي، مع الاستفادة من المنهج المقارن في الموازنة بين آيتي النشوز، وذلك من خلال بيان مفهوم النشوز في اللغة والاصطلاح واستعماله في القرآن الكريم، ثم دراسة وسائل معالجة نشوز المرأة ومقاصدها، ووسائل معالجة نشوز الرجل ومقاصدها، وصولًا إلى إجراء موازنة بين الآيتين في ضوء المقاصد القرآنية. وخلص البحث إلى أن القرآن الكريم أقام معالجة النشوز على مقاصد عليا، في مقدمتها حفظ الأسرة، وتحقيق السكن والمودة والرحمة، وإقامة العدل بين الزوجين، ودفع الظلم عن كل منهما، مع مراعاة طبيعة كل حالة وما يناسبها من وسائل الإصلاح. كما بيَّن أن اختلاف وسائل المعالجة لا يدل على اختلاف المقصد، وإنما يعكس تكامل التشريع القرآني في تحقيق الإصلاح الأسري، وأن المقصد الجامع للآيتين هو صيانة الأسرة واستمرار الحياة الزوجية على أساس العدل والإحسان. This study examines the comparison between the Qur'anic verses addressing the disobedience (nushūz) of the wife and that of the husband through an analytical approach based on the objectives (maqāṣid) of the Qur'an. The study aims to identify the similarities and differences between the Qur'anic approaches to both cases and to highlight the higher objectives underlying these legislative rulings in preserving family stability and establishing justice between spouses. The significance of the study lies in presenting an integrated reading of the two verses and demonstrating the coherence of the Qur'anic discourse beyond partial or isolated interpretations. The study adopts an analytical maqāṣid-based methodology, supported by a comparative approach. It begins by examining the linguistic and technical meanings of nushūz and its Qur'anic usage, then analyzes the Qur'anic methods for addressing the wife's and the husband's nushūz and the objectives underlying each approach, before conducting a comparative analysis of the two verses in light of the Qur'anic objectives. The study concludes that the Qur'an establishes the treatment of nushūz upon higher objectives, foremost among them preserving the family, promoting tranquility, affection, and mercy, achieving justice between spouses, and preventing injustice against either party. It further concludes that the difference in the methods of treatment does not imply a difference in purpose; rather, it reflects the comprehensive and balanced nature of the Qur'anic legislation in achieving family reform and safeguarding marital life.
