تفعيل مقاصد الزكاة في الواقع المعاصر في ضوء السياسة الشرعية

Résumé

يتناول البحث دور السياسة الشرعية في تفعيل فريضة الزكاة وتنزيل أحكامها على الواقع المعاصر، وتكمن أهميته في كونه يُفرد دراسة مستقلة تقرن بين السياسة الشرعية كإطار اجتهادي ومؤسسي وبين شعيرة الزكاة عبر التطبيقات والتنظيمات الحديثة، وتنطلق المشكلة من التساؤل عن كيفية إسهام الاجتهاد السياسي الشرعي، في تعزيز فاعلية الزكاة لتحقيق غاياتها الشاملة في الواقع المعاصر، كما يهدف البحث إلى تأصيل مشروعية تدخل السلطة التنظيمية في شؤون الزكاة، وإبراز أثر الاجتهاد المصلحي في تطوير آليات جبايتها وتوزيعها، ولتحقيق ذلك، اعتمد الباحث على المنهج الاستقرائي لجمع النصوص والآراء، والتحليلي لبيان الحِكم والمعاني، والمقاصدي لتقويم التطبيقات المعاصرة، وأظهرت أهم النتائج أن مقاصد الزكاة تتجاوز البعد التعبدي إلى أبعاد حضارية تتطلب إدارة مؤسسية رشيدة، وأن للسياسة الشرعية أهمية بالغة في تنظيم الزكاة، من خلال التوسع في الوسائل والإجراءات، من أجل الانتقال من مجرد الإعانة المؤقتة إلى التمكين التنموي والإغناء الدائم للمستحقين. Abstract: This research examines the role of Sharia-compliant policy in activating Zakat and applying its rulings to contemporary reality. Its importance lies in linking Sharia-compliant policy as an institutional framework with Zakat's civilizational and social objectives. The problem stems from how political-jurisprudential reasoning enhances Zakat's effectiveness to achieve its goals. It aims to establish the authority's legitimacy in regulating Zakat and highlight interest-oriented reasoning in its collection, distribution, and investment. The researcher adopted the inductive, analytical, and teleological (maqāṣidī) methodologies to evaluate contemporary applications. Findings show that Zakat's objectives transcend pure worship to civilizational dimensions requiring sound institutional management. They also affirm the vital role of Sharia-compliant policy in expanding contemporary procedures and regulations. Ultimately, this framework facilitates a transition from temporary relief to developmental empowerment and lasting self-sufficiency.
