Law No. 18-07 represents the cornerstone of the Algerian legislative framework for the protection of privacy and the sanctity of personal sphere of individuals in the context of digital transformation. It reconciles the requirements of data processing with the provision of a secure digital environment by establishing strict principles requiring the data subject’s informed consent and the lawfulness of the purpose. It also grants individuals fundamental rights, such as the right to obtain access to personal data, seek legal recourse, and have inaccurate data rectified. In addition, this legal framework strengthens the institutional framework by creating an independent supervisory body known as the National Authority for the Protection of Personal Data, responsible for regulating prior authorizations. This framework is supported by a deterrent punitive and penal system, including financial penalties and custodial sentences for offenders, with a view to aligning the legislation with international standards for data protection.
