Résumé

Electronic administrative decision-making is one of the most prominent manifestations of the digital transformation that has affected public administration, serving as a modern tool that reshapes the ways in which the administration expresses its binding and unilateral will, shifting it from traditional paper-based frameworks to a digital space governed by algorithms and electronic platforms. This study examines the duality posed by this transformation: On the one hand, electronic administrative decisions achieve tangible digital efficiency in the form of speed, accuracy, cost reduction, and easier access to public services for citizens; on the other hand, this transformation raises a number of risks that affect individuals’ rights and legal safeguards, such as algorithmic bias and the difficulty of ascertaining the exact content of a decision, and the inadequacy of existing legal texts to keep pace with these technologies. The study concluded that the essential elements of electronic administrative decisions do not differ fundamentally from those of traditional administrative decisions, and that judicial review remains the most effective safeguard for protecting individual rights, while the legislature must intervene to fill the existing legislative gap.
