As a general rule, criminal proceedings conclude with a judgment following all prescribed legal procedures before the court of first instance. However, some legal systems, including Algerian law, turn away from this principle within certain limits, particularly for minor offenses and misdemeanors, allowing the judgment and the punishment without prior pleadings before the competent court via the deliverance of a penal order. The penal order is one of the means that allow offenders to bypass the usual procedures of criminal trials, in respect of fundamental constitutional principles that reinforce the need for swift judgment in order to protect the rights of the parties and guarantee effective justice.
