Administrative Liability For Artificial Intelligence Applications In The Medical Field

Résumé

The medical sector is among the fields that have benefited most substantially from the deployment of technology and the harnessing of artificial intelligence techniques, contributing to remarkable advances in the delivery of healthcare services across all medical specialties. Notwithstanding these gains, the use of artificial intelligence in medicine is not without controversy. Questions arise regarding the manifold risks and serious challenges that the application of AI technologies in healthcare and medical practice entnails—risks no less significant than the promising opportunities it offers. Chief among these questions are those relating to administrative liability for artificial intelligence applications in the medical field, which is the subject of the present study. يعد القطاع الطبي من أهم المجالات التي استفادت بشكل كبير من توظيف التكنولوجيا واستثمار تقنيات الذكاء الاصطناعي فيها، مما ساهم في إحداث تطور هائل في تقديم الخدمات الصحية المختلفة في جميع التخصصات الطبية، ومع هذا فإن استخدام الذكاء الاصطناعي في مجال الطب لا يخلو من الجدل، إذ تثار التساؤلات حول ما يطرحه توظيف تقنياته في مجال الرعاية الصحية وممارسة مهنة الطب من مخاطر متعددة وتحديات جسيمة،لا تقل أهمية عن الفرص الواعدة التي يوفرها، لعلى أهمها التساؤلات المتعلقة بمسؤولية الادارة عن تطبيقات الذكاء الاصطناعي في المجال الطبي، وهو موضوع هذه الدراسة.
