في إطار تحديث القضاء التجاري، تركز هذه الورقة البحثية على استعراض قواعد الاختصاص النوعي للمحاكم التجارية المتخصصة المضمّنة في القانون الجديد رقم 22-13، مع توضيح أنواع النزاعات التي تُعنى هذه المحاكم بالنظر فيها. كما سيتم التطرق إلى قواعد الاختصاص الإقليمي، مع تسليط الضوء على التقسيمات الجديدة للمحاكم التجارية المتخصصة التي أُدخلت بموجب القانون رقم 22-07. وعلاوة على ذلك، سيتم شرح القواعد التي تُحدّد اختصاص هذه المحاكم بشكل دقيق، بما يضمن معالجة المنازعات التجارية الموكلة إليها بصورة متكاملة. وفي ختام الدراسة، تبيّن أن هذه التعديلات تسهم بشكل كبير في تعزيز دور القضاء في تحقيق الأمن القانوني، وذلك عبر تسريع إصدار أحكام قضائية نوعية من قبل قضاة متخصصين. غير أن هذا الأثر الإيجابي يمتد ليشمل الحياة التجارية والاقتصادية ومناخ الأعمال، كما يساهم في بناء الثقة الضرورية التي يحتاجها القطاع التجاري. This research paper examines the rules governing subject-matter jurisdiction of the specialized commercial courts introduced under the new Law No. 22-13, and delineates the categories of disputes over which these courts exercise jurisdiction. It further addresses the rules on territorial jurisdiction, highlighting the new jurisdictional divisions for specialized commercial courts established pursuant to Law No. 22-07. In addition, the paper sets out the rules that precisely determine the jurisdiction of these courts so as to ensure comprehensive adjudication of the commercial disputes entrusted to them. The study concludes that these amendments substantially reinforce the judiciary’s role in securing legal certainty, by expediting the issuance of high-quality judicial decisions rendered by specialized judges. This, in turn, exerts a positive impact on commercial and economic life and the business environment, while contributing to the consolidation of the trust required by the commercial sector.
