Abstract: This article examines the structural reforms introduced by Algerian Waqf Law No. 25-06 (19 July 2025) in the governance and investment of endowment assets. It situates these reforms within a maqāṣid al-sharīʿa framework, asking how far they align with the higher objectives of Islamic law — particularly the preservation of wealth and the preservation of progeny — understood in their contemporary sustainable-development dimensions. The study argues that the legislative shift from the classical model of asset endowment (ḥabs al-ʿayn) to a dynamic investment model (istithmār al-māl) is not a policy luxury but a juristic necessity grounded in the principle of fiqh al-maʾālāt: the foreseeable outcome of freezing waqf assets under conditions of persistent inflation is not preservation but progressive destruction of value. Drawing on Mālikī jurisprudence, the article analyses the debates on asset exchange (istibdāl), cash waqf, and investment funds, mapping them onto the new Algerian legislative architecture, and concludes that Law 25-06 provides a coherent institutional response that maximises the objectives of endowers and embeds intergenerational justice through cash waqf, specialised waqf banks, and digital governance.
