Résumé

This study aims to analyze the legal framework governing mining titles under Law No. 25-12 on Mining Activities (2025), by highlighting their concept and legal nature, and examining their role in ensuring legal certainty and enhancing the attractiveness of mining investment. The study also addresses the main innovations introduced by the new law in regulating mining titles and assesses their contribution to achieving a balance between the protection of mineral resources, as part of the national domain, and the promotion of investment in the mining sector. The study demonstrates that the Algerian legislator has moved towards modernizing the legal framework governing mining activities by establishing a clearer and more stable system for mining titles, thereby strengthening confidence in the legal investment environment and supporting the objectives of sustainable economic development. تهدف هذه الدراسة إلى تحليل النظام القانوني للسندات المنجمية في ظل القانون رقم 25-12 المتعلق بالنشاطات المنجمية لسنة 2025، من خلال إبراز مفهومها وطبيعتها القانونية، وبيان دورها في تحقيق الأمن القانوني وتعزيز جاذبية الاستثمار المنجمي. كما تتناول الدراسة أهم المستجدات التي جاء بها القانون الجديد في تنظيم السندات المنجمية، ومدى مساهمتها في تحقيق التوازن بين حماية الثروة المعدنية باعتبارها من الأملاك الوطنية، وتشجيع الاستثمار في القطاع المنجمي. وتبرز الدراسة أن المشرع الجزائري اتجه إلى تحديث الإطار القانوني المنظم للنشاطات المنجمية من خلال وضع نظام أكثر وضوحا واستقرارا للسندات المنجمية، بما يعزز الثقة في البيئة القانونية للاستثمار ويدعم أهداف التنمية الاقتصادية المستدامة.
