The transition from the right of permanent usufruct to the concession system represents a major legal phase in the management of agricultural lands belonging to the private domain of the State. The legislator has shifted toward adopting a legal framework that responds to the requirements of agricultural investment and modern management standards. In this context, the agricultural concession contract emerges as a legal mechanism granting the State the capacity to organize the exploitation of agricultural real estate according to specific conditions. Under these terms, the beneficiary concessionaire commits to managing and productively exploiting the land in exchange for an annual fee, as determined by Law No. 10-03. This necessitates an understanding of the legal nature of the concession contract and an clarification of the procedures for converting the right of permanent usufruct into a concession right. This process constitutes an administrative track subject to specific legal procedures in which the Wali plays a primary role. Thus, the concession system serves as a legal mechanism to rationalize the exploitation of agricultural real estate and ensure its direction toward achieving economic development.
