This study examines the role of European jurisprudence in interpreting and developing the concept of the right to informational independence under the provisions of the European General Data Protection Regulation (GDPR), as a fundamental right related to protecting privacy and human dignity in the digital environment. The study aims to demonstrate the extent to which European courts, represented by the Court of Justice of the European Union and the European Court of Human Rights, have contributed to defining the content of this right and highlighting its legal dimensions, as well as clarifying the scope of privileges granted to data subjects and the mechanisms for exercising them. The study concludes that European jurisprudence has not been limited to merely interpreting the provisions of the GDPR, but has played a constructive role in establishing the right to informational independence as a fundamental and independent right, based on empowering individuals to effectively control their personal data. The study also highlights that European courts have contributed to clarifying the content of the rights associated with this right, most notably the right of access to data, the right to rectification, the right to erasure or obliteration, the right to object to processing, and the right to data portability.
