الشرعية و المشروعية في الأنظمة القانونية

Résumé

إذا كان الغرب يتغنى بأنه يمثل نموذج دولة القانون و أكثر شرعية ، فإن الإسلام لا يقل شأناً عنه في ذلك فشرعية أحكامه مستمدة من أحكام الله تعالى وهي التي تحدد مدى شرعية الفعل أو العمل ، وكل ذلك يقاس بمدى موافقة لمقاصد الشرعية ، على غرار الأنظمة القانونية ،التي تستمد شرعيتها من التشريعات البشرية الخاضعة للأهواء والاخطاء والزلل ، هنا تظهر أصالة الإسلام لإحكامه وخلوها من التناقض ومسايرة للواقع ، ومن ذلك جاءت الدراسة لتبين سمو الشريعة الإسلامية على الأنظمة القانونية و انها أكثر شرعية ، وهذا ما جعلنا نصل إلى أن كل مسألة قانونية إلا ولها ما يقابلها في الشريعة الإسلامية ، وما الشرعية و المشروعية إلا نموذج لثراء الفقه الإسلامي على الغربي . Summary: If the West boasts of representing a model of the rule of law and greater legitimacy, Islam is no less in this regard, as the legitimacy of its rulings is derived from the commands of Allah, which determine the legality of any act or deed. All of this is measured by the extent to which it aligns with the objectives of Sharia, similar to legal systems that derive their legitimacy from human legislation, which is subject to whims, errors, and mistakes. Here, the authenticity of Islam is evident in the consistency of its rulings, their freedom from contradiction, and their alignment with reality. This study, therefore, aims to highlight the superiority of Islamic Sharia over legal systems and its greater legitimacy. This leads us to conclude that every legal issue has its counterpart in Islamic Sharia, and that legitimacy and lawfulness are merely a model reflecting the richness of Islamic jurisprudence compared to Western jurisprudence.
