تحرير الخلاف عند الأصوليين - كتاب نفائس الأصول للقرافي أنموذجا-

Résumé

يتناول هذا البحث جزئية مهمّة من جزئيات البحث الأصولي، وهي مسألة تحرير الخلاف في أصول الفقه، وذلك لظهور كثير من المسائل الأصولية الخلافية التي اعتراها بعض الغلط و عدم التدقيق فيها، فانبرى لذلك أئمة فحول عُنوا بتحريرها من خلال تحرير محلّ الخلاف فيها، و تحرير الأقوال المتناقلة، وكذا تحرير السبب المؤدي إلى هذا الخلاف، وكان من بين أولئك الفحول الإمام القرافي المالكي الأصولي، الذي سار في كتابه " نفائس الأصول" بصفة خاصة وفي سائر كتبه عامّةً على منهج التدقيق و الفحص و التهذيب، مُنزوِيًا عن التقليد المحض و النقل المجرّد. The research deals with an important part of fundamentalist research, which is the issue of editing disagreement in the principles of jurisprudence, due to the emergence of many controversial fundamentalist issues that were plagued by some errors and lack of scrutiny, so many imams became aware of this and took care to edit theme by editing the subject of disagreement in theme, and editing the transmitted sayings, as well as editing the reason leading to this disagreement, and among those stalwarts was imam al-qarafi, who in his book nafa'is al-usul in particular and in all his other books in general, who followed the method of scrutiny and refinement lsolated from pure imitation and abstract transmission.
