Résumé

Al-Bashir Al-Ibrahimi once observed : “They preoccupied them with trivial partisan matters until the café became more appealing to them than the mosque, the newspaper more desirable than the book, and partisan debates more enjoyable than scholarly discussions.” This is precisely what happens to journalism when it adopts an approach devoid of conscience : it becomes an instrument for destabilising society and confusing public opinion rather than an honourable means of building a society governed by transparency, truth, and ethical values. Joseph Goebbels was therefore not mistaken when he said : “Give me a media without conscience, and I will give you a people without awareness.” Indeed, when the media abandon their noble mission, the consequences include the corruption of minds, the erosion of principles, and the destruction of fundamental values. The media, therefore, constitute a social phenomenon and an essential necessity for both society and the state. They form an integral part of the social and political structure and play a crucial role in shaping public opinion and addressing issues related to society and the state. The media also represent one of the most significant manifestations of freedom of opinion and expression—among the fundamental political freedoms recognised by constitutions and legal systems around the world as essential rights. Nevertheless, these freedoms are subject to specific limitations and legal regulations established by the legislature. Consequently, legislators worldwide have devoted considerable attention to regulating the media in order to ensure that they serve the interests of the state, society, and citizens through laws and legal provisions governing journalistic practice. Accordingly, this study examines the development of media and audiovisual legislation in Algeria through an analysis of the principal laws that have governed the sector since 1990, culminating in the adoption of two new laws in 2023 : Organic Law No. 23-14 on Information and Law No. 23-20 concerning Audiovisual Activity. The study focuses on analysing the legal framework governing the practice of journalism in Algeria under these laws and explores how a balance may be achieved between media freedom and professional responsibility in the context of ongoing political and technological transformations. The study reveals that the Algerian legislature has gradually moved from a period of state monopoly over the media to a phase characterised by regulation and oversight through independent regulatory bodies, while incorporating the principles of transparency, respect for national values, and professional ethics. It also highlights the importance of the new legal framework in promoting professionalism and safeguarding freedom of expression within the bounds of the law. At the same time, the study identifies persistent challenges related to the practical implementation of legislation and the effectiveness of regulatory and oversight mechanisms.
