This research aims to elucidate the substance of the Islamic jurisprudential maxim “No Divorce in a State of Ighlāq,” establish its juristic foundations, examine its implications for the branches of Islamic jurisprudence, and assess the extent to which Algerian legislation accommodates its rulings. The study demonstrates that Ighlāq encompasses any mental, psychological, or circumstantial condition that prevents a legally competent person from exercising conscious and deliberate volition when pronouncing divorce. The Islamic schools of jurisprudence have generally agreed that divorce does not take effect in a state of Ighlāq, with the exception of the Hanafis in the case of divorce pronounced under coercion. Although Algerian legislation does not expressly adopt this maxim, its substance is accommodated through the rules governing defects of consent, thereby allowing for its application, alongside the mechanisms of witnessing and official documentation. Accordingly, the maxim complements the objectives of Islamic law and legal policy in protecting the family and preventing the legal effects of divorce pronounced in a state of Ighlāq
