Prescription is considered one of the significant topics whose issues extend across various juristic chapters. Classical and contemporary jurists discussed it in scattered contexts while addressing possession and control, evidence and claims, hudud, and other related matters. Prescription may be acquisitive, and it may also be extinctive. This study is concerned with examining the effect of prescription on the forfeiture of ownership through a comparative study between Islamic jurisprudence and Egyptian law. It addresses the definition of prescription, defines ownership, clarifies its causes and types, and examines the extent to which each type may be subject to forfeiture. The study further explains the effect of prescription on the forfeiture of ownership by employing several research methodologies, most notably the inductive, descriptive, and analytical methods. The study reaches several conclusions, the most important of which are: that jurists generally employ the term “prescription” in its linguistic sense, namely the change of rulings over the passage of time; that ownership of tangible property is not subject to forfeiture, unlike ownership of benefits and usufruct rights, which may be forfeited by waiver; that prescription in Islamic jurisprudence does not, in itself, establish ownership for the possessor nor extinguish a previously established ownership right; and that the ruler (wali al-amr) may regulate litigation procedures in a manner that achieves public interest and ensures the stability of transactions in accordance with changing circumstances and conditions.
