إشكالات ومفاسد توزيع الثروة على الورثة قبل الوفاة والمسالك الشرعية لتفاديها

Résumé

تعنى هذه الدراسة بظاهرة توزيع أصحاب الثروة لأموالهم على ورثتهم قبل الوفاة، وترصد أهمّ مقاصدهم في ذلك، كما تكشف عن أهمّ الإشكالات المصاحبة لذلك التوزيع، والمفاسد المترتبة عليه، كما تعرّج على كلام الفقهاء على حكم هذا التصرّف من المتقدمين والمتأخّرين، ثم تقترح في هذا الخصوص بعضَ المسالك التي يتوقّع أن تحقّق المقاصد الحسنة لأصحاب الثروة دون الوقوع في تلك المفاسد والإشكالات، وقد اعتمدت الدراسة المناهج المناسبة لهذا الغرض: الاستقرائي والتحليلي والمقارن، وتوصلت الدراسة إلى نتائج أهمُّها: أنّ أظهر مقصد لأصحاب الثروة في توزيعها قبل الوفاة هو الخوف من تقطُّع الصلة بين أولادهم، وأنّ أنفعَ مَسلك لتفادي ذلك هو كتابة وصيّة بتقسيم التركة على شريعة الله تعالى، إذ بها يتحقّق امتثال أمر الرسول صلى الله عليه وسلم بها، وليس فيها أيّ مخاطرة أو تجاوز أو تقصير. Abstract : Praise be to Allah, and peace and blessings be upon the Messenger of Allah. This study examines the phenomenon of wealthy individuals distributing their assets to their heirs prior to death. It explores their primary motives behind such actions. The research also reviews the opinions of the early and later jurists regarding the legal status of this practice. Furthermore, it proposes certain approaches that may achieve the intended benefits for asset owners while avoiding the associated pitfalls. The study employs appropriate methodologies, including inductive, analytical, and comparative approaches. Its findings highlight, most notably, that the predominant motive for distributing wealth before death is the fear of estrangement among children. The most effective means of preventing such outcomes is drafting a will that divides the estate according to the law of God, thereby fulfilling the command of the Prophet (peace be upon him), without risk, excess, or deficiency.
