This study examines the subject of legal nationality in Islam as one of the modern issues related to the relationship between the individual and the state, and the rights and obligations arising from this relationship. In contemporary law, nationality constitutes a legal and political bond between a person and the state, granting the person the status of belonging to the state and providing legal protection, in return for compliance with the obligations imposed by the state’s legal system. The Islamic system, however, recognized a number of forms of affiliation that regulated the relationship between the individual and the political community and the state, such as the bond of Islam, the pledge of allegiance (bay‘ah), residence, dhimmah, covenant, and aman (protection and security). This study aims to clarify the concept of legal nationality in Islam and to identify the foundations upon which the relationship between the individual and the Islamic state was established, while explaining the rights and obligations arising from this relationship. The study concludes that Islam did not recognize nationality in its modern legal sense; however, it established general principles that achieve the purpose underlying nationality, namely, protecting the individual, regulating the individual’s relationship with the state, and ensuring security, stability, and justice among members of society.
