Résumé

This study deals with the jurisprudential and legal framework governing the sanctions resulting from the breach of conditions attached to a marriage contract, utilizing an analytical and comparative approach across Islamic jurisprudential schools (madhahib), legislation, and judicial practice within the Algerian legal system. The core research problem centers on the divergence between the broad latitude allowed for these conditions and the restrictive scope of their legal and jurisprudential sanctions. Consequently, the study evaluates the efficacy of Islamic jurisprudence and Algerian legislation in regulating these conditions, while exploring how the judiciary balances the stability of the solemn marital covenant with the fair restitution of the aggrieved party. The significance of this study lies in its integration of theoretical jurisprudential foundations with practical application to safeguard the family unit and protect the rights of both spouses, relying on an integrated descriptive, comparative, and analytical methodology. Ultimately, the study yields substantial findings, most notably: reaffirming the fundamental nature of contractual free will, the endorsement of valid conditions by both Sharia and Algerian legislation, and the efficacy of established legal mechanisms for seeking fault-based divorce (tatliq lil-darar) and financial compensation.
