Abstract: This study addresses the topic of mitigating circumstances in disciplinary penalties imposed on public employees through an analytical comparative approach between legal systems and the principles of Islamic jurisprudence. It aims to highlight the importance of considering the circumstances surrounding a disciplinary violation when determining the appropriate sanction. The study first examines the concept of the public employee in both statutory legislation and Islamic jurisprudence, then emphasizes that disciplinary penalties should not be applied mechanically, but rather in light of the employee’s personal circumstances, employment record, and the specific context of the committed act. The study demonstrates that mitigating circumstances may be personal, such as good faith, the absence of prior disciplinary violations, recent appointment, limited professional experience, and the employee’s health or psychological condition. They may also be objective, relating to the act itself, such as the limited extent of harm caused by the violation, the existence of a legitimate motive, exposure to influential pressures, voluntary confession, and cooperation during the investigation. The study further shows that Islamic jurisprudence is consistent, in essence, with the concept of mitigation, as it considers intention, repentance, unintentional ignorance, and the need to balance justice with mercy. The study concludes that administrative judiciary plays a significant role in regulating the exercise of disciplinary authority by reviewing the legality of disciplinary decisions, the proportionality between the violation and the penalty, the adequacy of reasoning, and the prevention of arbitrariness or misuse of power. The study recommends establishing clear legal standards that require disciplinary authorities to consider mitigating circumstances, in a manner that ensures disciplinary justice while preserving the proper functioning of public utilities
