مقاصد حفظ العرض في مواجهة التحرش والانتهاكات في الفضاءات الافتراضية الاجتماعية (دراسة تأصيلية تحليلية مقارنة)

Résumé
تتناول هذه الدراسة ظاهرةَ التحرش والانتهاكات الواقعة في الفضاءات الافتراضية الاجتماعية من منظور مقاصد الشريعة الإسلامية، ولا سيما مقصدَ حفظ العِرض الذي يُعدّ من الكليات المستقلة أو الملحقة بالضرورات في المنظومة المقاصدية. تسعى الدراسة إلى تأصيل مفهوم حفظ العِرض في السياق الرقمي المعاصر، واستجلاء مدى كفاية التأطير الفقهي المقاصدي لمواجهة الأشكال الحديثة من العدوان الافتراضي، مع قراءةٍ تحليليةٍ نقدية في المشهد التشريعي لبعض الدول العربية. اعتمد البحث المنهجَ الاستقرائي التحليلي، والمنهجَ المقارن، ومنهجَ التأصيل التطبيقي. وخلصت الدراسة إلى أن مقصد حفظ العِرض يستوعب بنيوياً التحرشَ الرقمي بصوره كافة، وأن تحقيق هذا المقصد في العصر الرقمي يستلزم رؤيةً تكامليةً تجمع بين الاجتهاد المقاصدي، والتشريع الوضعي المنسجم، والتقنيات الحمائية، والتنشئة الأخلاقية، مع اقتراح منظومة تعزيرية رقمية مُدرَّجة ومفهوم الحصانة الرقمية بوصفهما إضافتين علميتين أصيلتين. This study examines harassment and violations occurring in virtual social spaces from the perspective of Islamic legal objectives (Maqāṣid al-Sharī'ah), particularly the objective of protecting honor (ḥifẓ al-'irḍ) as one of the essential universals in the Maqāṣid system. The study aims to ground the concept of honor protection within the contemporary digital context, assessing whether the existing jurisprudential framework adequately addresses emerging forms of virtual aggression, alongside a critical analytical reading of Arab legislative frameworks. The study adopts inductive-analytical, comparative, and applied jurisprudential methodologies. It concludes that ḥifẓ al-'irḍ structurally accommodates all forms of digital harassment, and that realizing this objective in the digital age requires an integrated vision combining Maqāṣid-based jurisprudential reasoning, coherent positive legislation, protective technologies, and moral education, while proposing a graduated digital discretionary punishment system (ta'zīr) and the concept of digital immunity as original scholarly contributions.
