ملخص: موضوع التمييز بين مدرسة الرأي ومدرسة الحديث موضوع له أهمية من حيث كشف ضوابط التمييز بين المدرستين, وبالرجوع إلى كتب تاريخ المقالات العقائدية وكتب تاريخ التشريع يتبين لنا أن المدرستين يتفقان في أصول الدين الكبرى ويختلفان في مسائل الاجتهاد العملية التي تفرضها أصول كل من المدرستين. وبالتتبع توصل البحث إلى أن لقواعد المدرستين أثرا على فقه المعاملات . كما ناقش البحث بعض الضوابط التي ذكرها المعاصرون فيما يتعلق بالتعليل والتقصيد للتمييز بين المدرستين واثبت من خلال التمثيل الفقهي أن كلتا المدرستين تُعملان النظر المقاصدي، وأن الخلاف بينهما راجع لأصول وقواعد الاستدلال لا إلى ذات التعليل والتقصيد. Abstract : The distinction between the school of opinion and the school of hadith is important in revealing the criteria for differentiating between the two. By consulting books on the history of doctrinal articles and books on the history of Islamic jurisprudence, it becomes clear that the two schools agree on the major principles of religion but differ in the practical matters of legal reasoning necessitated by the principles of each school. Further investigation has revealed that the rules of both schools have an impact. on the jurisprudence of transactions. The research also discussed some of the criteria mentioned by contemporary scholars regarding reasoning and intent to distinguish between the two schools, and proved through jurisprudential representation that both schools employ teleological reasoning, and that the difference between them is due to the principles and rules of argumentation, not to the nature of reasoning and intent.
