Abstract : Humanity and violates human rights and freedoms, thus transcending the geographical borders of countries. This scourge is characterized by being an organized global crime that crosses borders due to the technological revolution,. WHICH has also contributed to the increase and growth of this criminal phenomenon, as it affects all segments of society, especially children and women of different races and ages without exception, through sexual exploitation, forced labor, and kidnapping for the purpose of financial gain Consequently, this type of crime has become a terrible danger at both the international and national levels, which has led countries to intervene with concerted efforts by establishing a legal arsenal to limit the growth of this type of crime. The United Nations adopted the Convention against Transnational Organized Crime in 2000, along with its Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children, who are the most common victims. The Algerian criminal policy was a pioneer in this field, by ratifying the United Nations Convention against Transnational Organized Crime by virtue of Presidential Decree No. 02-55 dated February 5, 2002 , and enacting Law No. 09/01 amending Article 303 bis 4 of the Penal Code, which was repealed. Finally, the Algerian legislator addressed the deficiency by creating a new law, Law No. 23/04, and the purpose of this legal arsenal is prevention and deterrence at the same time
