النصوص الاتفاقية لمكافحة الاتجار بالبشر

Résumé

تُعتبر جريمة الاتجار بالبشر من أخطر الجرائم في العصر الحديث، فهي تُهدد الأمن والاستقرار في المجتمع الدولي المعاصر، مما دعا في هذه الدراسة إلى تناول النصوص الاتفاقية لمكافحة الاتجار بالبشر، وذلك من خلال البحث والتطرق إلى الاتفاقيات الدولية العالمية العامة والاتفاقيات الدولية العالمية الخاصة والاتفاقيات الإقليمية لمكافحة الاتجار بالبشر، وهذا في ضوء السؤال الرئيسي والإشكالية الآتية: ما مدى فعالية النصوص الاتفاقية في مكافحة الاتجار بالبشر ؟ إن هدف هذه الدراسة إبراز الاتفاقيات الدولية والإقليمية لمكافحة الاتجار بالبشر، وهذا اعتمادًا على المنهج التحليلي في نقد النصوص والمنهج الوصفي في البيان والمنهج المقارن للقواعد والأحكام. وقد خلصت بنتائج أهمها أن المجتمع الدولي سن عديد الاتفاقيات الدولية والإقليمية، وقد نجم عنها عددًا من المؤسسات الدولية العالمية والإقليمية لمكافحة الاتجار بالبشر إلا أن ذلك لم يحد منه، وهذا لفاعلية نشاط العصابات المنظمة له، وتكيفها مع السبل المستحدثة لمواجهتها. Human trafficking is considered one of the most serious crimes of the modern era, threatening the security and stability of the contemporary international community. This study therefore addressed the conventions to combat human trafficking. This was done by examining and examining general global international conventions, specific global international conventions, and regional conventions to combat human trafficking. This is in light of the main question and the following problem: How effective are the provisions of the agreements in combating human trafficking ? The aim of this study is to highlight international and regional conventions to combat human trafficking, relying on an analytical approach to textual criticism, a descriptive approach to explanation, and a comparative approach to rules and provisions. The study concluded with the most important results, including that the international community has enacted numerous international and regional conventions, which have resulted in a number of international and regional institutions to combat human trafficking. However, this has not curbed it, due to the effectiveness of the organized gangs and their adaptation to new methods to confront it.
