Résumé
تتناول هذه الدراسة مسألة الاعتداءات الحديثة التي تتعرض لها الممتلكات الثقافية في ظل الاحتلال الحربي, وكنموذج تطبيقي استشهدنا بوضع الممتلكات الثقافية الفلسطينية في ظل الاحتلال الاسرائيلي,حيث تبرز أهمية هذا البحث في كونه من الموضوعات التي أوليت لها عناية خاصة من طرف أعضاء المجتمع الدولي والقانون الدولي الإنساني على حد سواء, ومن خلال تحليلنا لهذا الموضوع إعتمدنا على المنهج الوصفي والتحليلي والتاريخي والنقدي بإعتبارهم الأنسب لمثل هذا النوع من الدراسات, ومن أهـم النتائج المتوصل لها في إطار هذا البحث هي أن الممتلكات الثقافية في الأقاليم المحتلة حربيا تتعرض إلى تهديدات خطيرة غير مباشرة تهدد كيانها وديمومتها, كما أن تمادي دولة الاحتلال في اعتداءاتها الموجهة ضد الممتلكات الثقافية للدول المحتلة اقاليمها, ناتج عن ضعف تفعيل قواعد المسؤولية . This study addresses the issue of modern attacks on cultural property under military occupation. The importance of this research is highlighted by the fact that it is one of the topics to which special attention has been paid by members of the international community and international humanitarian law alike. Through our analysis of this topic, we relied on the descriptive, analytical, historical and critical approaches, considering them the most appropriate for this type of study One of the most important findings reached within the framework of this research is that cultural property in the militarily occupied territories is exposed to serious indirect threats that threaten its entity and sustainability, and the persistence of the occupying state in its attacks directed against the cultural property of the countries whose territories are occupied is the result of weak activation of the rules of responsibility.
