تهدف هذه الورقة البحثية إلى دراسة تأثير الذكاء الاصطناعي على نظرية الالتزام، من خلال تناول مفهومي الإرادة والمسؤولية، حيث يشهد هذا المجال تحولات عميقة نتيجة تدخل الأنظمة الذكية في إبرام وتنفيذ التصرفات القانونية، مما يثير إشكالات تتعلق بمدى توافر الإرادة البشرية في ظل الاعتماد على الخوارزميات، وكذا تحديد المسؤولية عند حدوث أضرار. كما تسعى الورقة إلى تحليل مدى كفاية القواعد التقليدية لاستيعاب هذه التغيرات، للوصول في الأخير إلى تقديم اقتراحات قانونية حديثة تضمن التوازن بين الابتكار التكنولوجي وحماية المراكز القانونية للأطراف. This research paper aims to study the impact of artificial intelligence on the theory of obligation by addressing the concepts of will and responsibility. This field is witnessing profound transformations as a result of the intervention of intelligent systems in concluding and executing legal acts. This raises issues related to the extent of human will in light of reliance on algorithms, as well as determining liability when damages occur. The paper also seeks to analyze the adequacy of traditional rules to accommodate these changes, ultimately aiming to offer modern legal proposals that ensure a balance between technological innovation and the protection of the legal positions of the parties.
